1. About this policy
1.1 What this is. This Acceptable Use Policy ("AUP") sets out what you may and may not do with GlamOps. It is part of the GlamOps Terms of Service for Businesses (the "Terms") between GlamOps LLC ("GlamOps," "we," "us") and the Business.
1.2 Who it applies to. This AUP applies to the Business, its Team Members, and anyone else who uses the Services through the Business's Account. The Business is responsible for making sure everyone using its Account follows this AUP.
1.3 Definitions. Capitalized words have the meanings given in the Terms, including Business, Client, Customer Data, Business Content, Booking Site, Messaging Features, AI Features, Platform, Services, Team Member and Third-Party Services.
1.4 The short version. Run a lawful, licensed business. Be honest with your Clients. Message only people who have agreed to hear from you. Respect other people's rights and data. Don't attack, abuse or copy GlamOps.
2. Lawful, licensed businesses only
You may not use the Services to offer, promote, book or take payment for:
2.1 Illegal services or products. Anything that is illegal where you or your Client is located.
2.2 Unlicensed services. Any service you (or the Team Member performing it) are not licensed, certified or otherwise legally allowed to perform. This includes, for example, offering advanced nonablative esthetics procedures (such as laser hair removal, skin rejuvenation, body contouring or tattoo removal) in Oregon without the required certification from the Oregon Health Licensing Office, or operating a facility without a required facility license.
2.3 Medical services outside your scope. Services that require a medical license (for example, injections, prescription treatments, or medical diagnosis) unless they are performed by, or under the supervision of, a properly licensed health care professional as the law requires. Med spas and similar practices may not currently use the Services for medical services, including injectables (such as Botox or fillers) and prescription treatments.
2.4 Sexual services. Adult or sexual services, or services marketed in a sexual way.
2.5 Restricted products and services. Products or services that Stripe prohibits, or restricts without its prior approval, including:
- (a) CBD products;
- (b) prescription-only drugs and products, and pharmaceuticals, sold without an in-person prescription relationship (for example, selling tretinoin or other prescription skincare online);
- (c) prescription-only or regulated medical devices;
- (d) telemedicine or telehealth services;
- (e) "pseudo-pharmaceuticals" or nutraceuticals that are unsafe or make harmful claims;
- (f) gift cards, prepaid cards, stored value or account credits, except as the Services expressly support and as the law allows; and
- (g) any other business on Stripe's Prohibited and Restricted Businesses list (https://stripe.com/legal/restricted-businesses).
2.6 Weapons, drugs, tobacco and alcohol sales. Firearms, ammunition, illegal drugs, drug paraphernalia, cannabis, tobacco or vaping products, or alcohol (including alcohol offered as part of a service package).
3. Honest dealing with Clients
You may not use the Services to:
3.1 Make misleading health or results claims. For example, claiming a service or product cures, treats or prevents a disease or medical condition (such as "cures acne," "heals eczema" or "permanently reverses aging"), guaranteeing results, or making claims you cannot support with evidence.
3.2 Use deceptive pricing or offers. For example, hiding fees, advertising a price you don't actually charge, showing a fake "regular price," running fake countdowns or "today only" sales that are not true, or failing to disclose the terms of a deposit, cancellation fee or no-show fee before booking.
3.3 Use fake or manipulated reviews. For example, posting fake reviews or testimonials, paying or rewarding Clients only for positive reviews, hiding or suppressing negative reviews, or presenting reviews by you, your staff or family as independent.
3.4 Hide your policies. Fail to show your cancellation, deposit, no-show and refund policies to Clients before they book or pay, or charge fees your policies do not allow.
3.5 Impersonate others. Pretend to be another business or person, or suggest that you are affiliated with or endorsed by someone (including GlamOps or another software company) when you are not.
3.6 Discriminate unlawfully. Refuse service, set different terms, or advertise in a way that unlawfully discriminates against Clients based on a protected characteristic.
3.7 Misuse health information. Collect health-related information you don't need, use it for anything other than providing your services safely, or collect or share it without any notice or consent the law requires.
4. Email and text messages
4.1 Consent first. You may not send:
- (a) marketing text messages to anyone who has not given prior express written consent to receive them from your business through the Services' opt-in process (checkbox and "YES" confirmation);
- (b) any text message, including reminders, to anyone who has not given consent to receive texts from your business at that number;
- (c) marketing emails to anyone who has not opted in to marketing email from your business (through the email opt-in box at booking or in the Client Portal, or by telling you, which you then truthfully recorded in the Services); or
- (d) any message to someone who has opted out.
4.2 No bought or borrowed lists. You may not message purchased, rented, scraped, shared, traded or third-party lists, or contacts who did not give their details directly to your business. Consent cannot be bought, sold or transferred.
4.3 Don't get around our controls. You may not:
- (a) re-subscribe or re-add people who opted out, or create duplicate Client records to get around an opt-out;
- (b) change a Client's phone number to text them without new consent;
- (c) mark imported contacts as having text consent;
- (d) try to bypass quiet hours, frequency limits, double opt-in, unsubscribe links or other sending rules;
- (e) open multiple accounts or numbers to get around limits or blocks ("snowshoeing"); or
- (f) use tricks to avoid carrier or spam filters, such as public URL shorteners, deliberate misspellings, or disguised opt-out words.
4.4 Spam. You may not send unsolicited bulk messages, chain messages, or messages that a reasonable recipient would consider spam.
4.5 Honest messages. Your messages must identify your business. Subject lines, preview text, sender names and content must not be false or misleading. Marketing emails must include your valid physical postal address and a working unsubscribe link. Appointment reminders and booking confirmations must not include promotional content.
4.6 Prohibited text message content ("SHAFT" and more). Text messages sent through the Services must not contain or promote:
- (a) Sex or sexually explicit content;
- (b) Hate speech, harassment or content that promotes violence or discrimination;
- (c) Alcohol (including "wine and facial" style promotions);
- (d) Firearms, ammunition or weapons;
- (e) Tobacco, vaping or nicotine products;
- (f) cannabis, CBD or illegal drugs;
- (g) prescription drugs or pharmaceutical sales (including injectables such as Botox or fillers);
- (h) gambling, sweepstakes requiring purchase, high-risk financial offers, loans, debt relief or cryptocurrency; or
- (i) anything else our messaging providers or the wireless carriers prohibit.
4.7 Phishing and malicious links. You may not send messages that try to collect passwords, card numbers or other sensitive information under false pretenses, or that link to malware or deceptive sites.
4.8 Complaint levels. You must keep complaints, bounces and opt-outs at low levels. We may pause your messaging if your spam complaint rate, bounce rate or opt-out rate is high (for example, email complaints at or above 0.08% or bounces at or above 4%, the limits set by our email provider), or if a carrier or provider flags your messages.
4.9 Provider rules. You must also follow the rules of our messaging providers as they apply to your messages, including Twilio's Messaging Policy and Acceptable Use Policy and Resend's Acceptable Use Policy, and the CTIA Messaging Principles and Best Practices.
5. Harassment, harmful and offensive content
You may not use the Services (including your Booking Site, forms, messages, Client notes and AI Features) to:
5.1 harass, bully, threaten, stalk or intimidate anyone;
5.2 post or send hate speech, or content that promotes violence or discrimination against people based on a protected characteristic;
5.3 post sexually explicit content, or any content that sexualizes minors (we report child sexual abuse material to the authorities);
5.4 post private or identifying information about someone without permission (for example, posting a Client's photo, name or health details publicly without consent); or
5.5 post content that is defamatory, obscene, or otherwise unlawful.
6. Intellectual property and other people's rights
You may not:
6.1 upload or use content (including photos, logos, music, videos, fonts or text) that you don't own or have permission to use;
6.2 post before-and-after or other photos of a Client without that Client's permission;
6.3 use another company's trademarks in a way that suggests affiliation or endorsement, or that is likely to confuse people;
6.4 copy another business's website, branding or content; or
6.5 import data you don't have the right to use, or log in to another company's software (including another booking platform) using credentials that are not yours or in violation of that company's terms.
We respond to copyright notices as described in Section 15 of the Terms and our Copyright and DMCA Policy at https://glamops.net/legal/copyright, and we terminate repeat infringers in appropriate circumstances.
7. Security and abuse of the Services
You may not, and may not help anyone else to:
7.1 access or try to access another Business's Account, data or Booking Site, or any part of the Services you are not authorized to use;
7.2 probe, scan or test the vulnerability of the Services, or breach or bypass any security or authentication measure, except through a responsible disclosure program we publish;
7.3 interfere with or disrupt the Services, including through denial-of-service attacks, flooding, overloading, or sending malware, viruses or other harmful code;
7.4 use the Services to host or distribute malware, or to run phishing pages or credential-collecting forms;
7.5 share login credentials, create accounts with false information, or create accounts by automated means;
7.6 use the Booking Site, Client Portal or payment features to test stolen cards, commit fraud, or launder money;
7.7 scrape, crawl, harvest or collect data from the Services (including other Businesses' Booking Sites) by automated means, except through APIs or export tools we provide, and only for your own data;
7.8 reverse engineer, decompile, disassemble or try to derive the source code, models, algorithms or underlying structure of the Services, except to the extent the law expressly allows this despite this restriction;
7.9 copy, frame or mirror any part of the Services, or use the Services to build a competing product or service;
7.10 resell, sublicense or provide the Services to anyone other than your own business, or use one Account for multiple unrelated businesses; or
7.11 use the Services in a way that exceeds reasonable usage limits, or that we reasonably believe puts an unreasonable load on our systems or Third-Party Services.
8. AI Features
When using Concierge or any other AI Features, you may not:
8.1 try to get the AI Features to reveal, access or guess other Businesses' data, other Clients' data, or any data outside your own Account;
8.2 try to get the AI Features to reveal their system instructions, prompts, configuration, security controls or other internal details of the Services, or to bypass their safeguards (sometimes called "prompt injection" or "jailbreaking"), including by placing hidden instructions in Business Content, Client notes or imported data;
8.3 use the AI Features to diagnose skin or health conditions, recommend medical treatments, or make other medical, legal or financial decisions without qualified human judgment;
8.4 use the AI Features to create content that violates this AUP, including deceptive marketing, fake reviews, harassment or spam;
8.5 use the AI Features to make decisions about people that have legal or similarly significant effects on them (for example, decisions about employment, housing, credit or insurance);
8.6 use automated scripts or tools to send questions, or try to get around the daily question limit;
8.7 use AI output to train or develop another AI model; or
8.8 use the AI Features in a way that violates the usage policy of our AI provider, Anthropic, as it applies to you.
9. Booking Sites and tracking
You may not:
9.1 use a Booking Site for anything other than promoting and taking bookings and payments for your own lawful business;
9.2 use a subdomain or custom domain that is misleading, infringes someone's trademark, or impersonates another business;
9.3 add third-party analytics, tracking tools, advertising pixels or session-recording tools to your Booking Site, Client Portal, intake forms or payment pages; or
9.4 use location-based advertising or geofencing based on data from the Services.
10. Reporting violations
If you believe someone is violating this AUP, please email admin@glamops.net with as much detail as you can. To report a security vulnerability, email admin@glamops.net. To report copyright infringement, follow our Copyright and DMCA Policy at https://glamops.net/legal/copyright.
11. Enforcement
11.1 Investigation. We may investigate suspected violations of this AUP. We may review Business Content, messages, consent records and Account activity as needed to do so. You must cooperate with reasonable requests, including requests to show proof of Client consent.
11.2 What we may do. If we believe you have violated this AUP, or that your use creates risk for GlamOps, Clients, message recipients, other Businesses or our providers, we may take any of these actions, with or without notice, depending on how serious the issue is:
- (a) warn you and ask you to fix the problem;
- (b) remove or disable content, including content on your Booking Site;
- (c) block, delay or throttle messages, or require you to re-collect consent;
- (d) suspend specific features, such as Messaging Features, AI Features, payments or your toll-free number;
- (e) suspend your Account; or
- (f) terminate your Account under Section 19 of the Terms.
We will try to respond in proportion to the problem. Where a problem is minor and fixable, we will usually ask you to fix it first. We may act immediately where there is a risk of harm, a legal requirement, or a provider or carrier demand.
11.3 Reporting to others. We may report suspected illegal activity to law enforcement or regulators, and may share relevant information (including consent records) with Stripe, wireless carriers, our messaging providers, and other affected parties when they request it or when we believe it is needed to stop harm or comply with law.
11.4 No refunds for violations. If we suspend or terminate your Account because you violated this AUP, you will not receive a refund of prepaid fees.
11.5 No duty to monitor. We do not promise to monitor the Services for violations. If we don't act on a violation, that does not mean we approve of it or waive our right to act later.
11.6 Your responsibility continues. Our enforcement actions do not limit your responsibility under the Terms, including your duty to indemnify us under Section 23 of the Terms.
12. Changes to this policy
We may update this AUP from time to time, for example when laws or our providers' rules change. We will post the new version with a new "Last updated" date. If a change materially restricts how you use the Services, we will notify the Account Owner by email at least 30 days in advance, unless a shorter period is needed to comply with law, a provider or carrier requirement, or to address a security or abuse risk.
