Summary of key terms (not a substitute for the full Terms)
Please read these key points
---
GlamOps is software for your beauty business. You (the Business) run your business; GlamOps provides the tools.
Free trial, then Standard ($24.99/month or $255/year) or Pro ($49.99/month or $510/year), automatically renewed. See Section 6 for the full subscription terms.
You can cancel online at any time in Settings → Billing. Cancellation takes effect at the end of your paid period.
Client payments go through Stripe, not GlamOps. You are the merchant of record. You must accept Stripe's Connected Account Agreement (Section 9).
You own your data. You can export it at any time and for 30 days after your account ends (Section 13).
You are responsible for your services, licenses, forms, policies and messages to your Clients (Sections 10 and 11).
AI answers can be wrong and are never medical advice (Section 12).
Disputes: informal resolution first, then small claims court or the state or federal courts in Multnomah County, Oregon, on an individual basis only. No class actions (Section 24).
1. Who we are and what these Terms cover
1.1 These Terms are a contract. These Terms of Service (the "Terms") are a binding agreement between GlamOps LLC, an Oregon limited liability company ("GlamOps," "we," "us" or "our"), and the business that signs up for GlamOps ("you" or the "Business").
1.2 What GlamOps is. GlamOps is a software platform for estheticians and similar beauty professionals. It helps a Business run its own booking, client records, payments, marketing and related tasks.
1.3 GlamOps is not a party to your Client relationships. GlamOps does not provide esthetic or beauty services. GlamOps does not employ you or your staff. GlamOps is not a party to any appointment, sale, deposit, fee or other transaction between you and your Clients.
1.4 US only. The Services are offered only to businesses located in the United States, for use with Clients in the United States.
1.5 Other documents that form part of these Terms. The following documents are part of these Terms and are incorporated by reference:
- (a) the Acceptable Use Policy at https://glamops.net/legal/acceptable-use;
- (b) the Data Processing Addendum ("DPA") at https://glamops.net/legal/dpa;
- (c) any plan, pricing or order details shown to you at checkout or in Settings → Billing; and
- (d) any feature-specific terms that we show you when you turn on a feature (for example, the Messaging Terms at https://glamops.net/legal/messaging-terms).
1.6 Other documents you should read. Our Privacy Policy at https://glamops.net/legal/privacy explains how GlamOps handles personal information as a company. The Stripe Connected Account Agreement at https://stripe.com/connect-account/legal governs payment processing (Section 9).
1.7 Order of precedence. If these Terms conflict with another document listed in Section 1.5, the following order applies: (1) the DPA, for anything about processing Customer Data; (2) feature-specific terms, for that feature; (3) these Terms; (4) the Acceptable Use Policy.
2. Definitions
These words have the same meaning in these Terms, the Acceptable Use Policy, the DPA and the Privacy Policy.
- "Account" means the GlamOps account created for the Business.
- "Account Owner" means the individual who created the Account, or the individual the Business later names as its owner in Settings.
- "AI Features" means the "Concierge" assistant and any other feature of the Services that uses artificial intelligence to generate output.
- "Booking Site" means a website hosted by GlamOps for the Business, on a glamops.net subdomain or on a custom domain the Business connects.
- "Business" means the business entity or sole proprietor that signs up for the Services and accepts these Terms. Where the context requires, "Business" includes its Team Members acting on its behalf.
- "Business Content" means text, images, logos, prices, policies, forms and other materials the Business or its Team Members upload to or create in the Services, including content on its Booking Site. Business Content is part of Customer Data.
- "Client" means any individual who books with, buys from, signs a form for, receives messages from, or otherwise interacts with the Business through the Services. Clients are customers of the Business, not of GlamOps.
- "Client Portal" means the area of the Services where Clients can view or manage their appointments, forms and other information with the Business.
- "Customer Data" means all data and content submitted to or created in the Services by or for the Business, its Team Members or its Clients. This includes Business Content, Client contact details, appointment history, notes, intake and consent forms and signatures, photos, messages, product and inventory records, and transaction records. Customer Data does not include Usage Data or Aggregated Data. Card numbers are collected and held by Stripe, not GlamOps.
- "Aggregated Data" means data that has been combined or de-identified so that it does not identify, and cannot reasonably be linked to, the Business, any Team Member or any Client.
- "Messaging Features" means the email campaign, text-message campaign, appointment reminder and other messaging tools in the Services.
- "Platform" means the GlamOps website at glamops.net, the GlamOps web application, Booking Sites, the Client Portal, the GlamOps mobile apps, and any related software and APIs.
- "Services" means the Platform together with all related features, updates, support and other services we provide under these Terms.
3. Accepting these Terms
3.1 How you accept. You accept these Terms by checking the box and clicking the button at sign-up that says you agree to these Terms (or by a similar clear action we present to you). If you do not agree, do not use the Services.
3.2 We keep a record. When you accept these Terms, we record the Account, the individual who accepted, the date and time, IP address, device or browser information, the version of these Terms, and the wording shown to you. We keep archived copies of every version of these Terms.
3.3 Team Members. Each Team Member must agree to the Acceptable Use Policy and the parts of these Terms that apply to users before using the Account. The Business remains responsible for its Team Members (Section 5.3).
4. Eligibility
To use the Services, you confirm that:
- (a) you are at least 18 years old;
- (b) you are signing up for business purposes, not personal, family or household purposes;
- (c) if you sign up for a company or other organization, you have authority to accept these Terms for it, and "you" means that organization;
- (d) your business is located in the United States;
- (e) you, your business and its owners are not on any U.S. government sanctions or restricted-party list (including lists maintained by the Office of Foreign Assets Control) and are not located in an embargoed country or region;
- (f) you have not previously had a GlamOps account suspended or terminated for violating these Terms, unless we agreed in writing that you may return; and
- (g) the information you give us at sign-up and later is true, accurate and complete, and you will keep it up to date.
5. Accounts, Team Members and security
5.1 Your Account. The Account belongs to the Business. The Account Owner controls the Account, including billing, Team Member access, data exports and cancellation.
5.2 Team Members and roles. You may invite Team Members and assign them roles (for example owner, manager or staff). Roles control what each Team Member can see and do. You are responsible for choosing appropriate roles, and for removing access promptly when someone leaves your business.
5.3 You are responsible for your Team Members. You are responsible for everything that happens under your Account, including the acts and omissions of your Team Members, as if you did them yourself.
5.4 Keep your Account secure. You must:
- (a) keep login credentials confidential and not share logins between people;
- (b) use multi-factor authentication when we offer it;
- (c) use the Services only on devices you reasonably secure; and
- (d) tell us promptly at admin@glamops.net if you learn of any unauthorized access to your Account or any security incident affecting it.
5.5 Account deletion. You may delete your Account from within the Platform, including in the mobile apps. Deleting your Account cancels your subscription and ends these Terms as described in Section 19. Section 13.5 explains what happens to your data.
5.6 Ownership disputes. If there is a dispute about who controls an Account (for example, between business partners), we may rely on our records and reasonable documentation, and we may freeze the Account until the dispute is resolved. We are not responsible for deciding disputes between people inside your business.
6. Subscription, free trial and automatic renewal
SUBSCRIPTION AND AUTOMATIC RENEWAL TERMS: PLEASE READ
---
Free trial: Your first 30 days are free. No card needed to start.
After the trial, your subscription automatically renews: If you have chosen a plan and added a payment method, on the day your trial ends (the date shown in Settings → Billing), your subscription starts automatically and we will charge your payment method the price of the plan you chose (Standard: $24.99 per month or $255 per year; Pro: $49.99 per month or $510 per year), plus any applicable tax, unless you cancel before the trial ends.
Recurring charges until you cancel: We charge the fee in advance, on the same day each month (monthly plans) or each year (yearly plans), until you cancel.
How to cancel: Cancel online at any time in Settings → Billing → Cancel subscription. You do not need to call or chat with anyone. You can also email admin@glamops.net. To avoid being charged, cancel before your trial ends.
When cancellation takes effect: At the end of your current paid period. You keep access until then.
Refunds: No refunds or credits for partial months or years, except where the law requires or as stated in Section 6.9.
Price changes: We will tell you at least 30 days before any price change, and you can cancel before it takes effect.
6.1 Free trial. New Businesses get one free trial of 30 days, unless a different trial length is shown at sign-up. The trial includes the features of the Pro plan. One free trial per Business. We may refuse a trial to a Business that has already had one, including under a different account.
6.2 End of a trial without a payment method. If you did not give us a payment method, we will not charge you when the trial ends.
6.3 Continuing after the trial. To keep using the Services, you must choose a plan, give us a payment method and agree to the automatic renewal terms. We will remind the Account Owner by email 7 days, 3 days and 1 day before the trial ends, and on the day it ends. If you have not chosen a plan when the trial ends, everything keeps working for 3 more days. After that, your Account will be paused as described in Section 7.4 until you choose a plan, and features that are only in the Pro plan stop working. Your data is kept.
6.4 Reminder before your trial ends. We will email the Account Owner 7 days before a trial converts to a paid subscription. The email will state the amount, the date of the first charge, and a link to cancel.
6.5 Confirmation. After you start a trial or subscription, we will email you a confirmation you can keep. It will show your plan, price, billing frequency, trial end date and first charge date, how to cancel (with a direct link), and how to contact us.
6.6 Plans, subscription term and renewal. We offer a Standard plan and a Pro plan, each billed monthly or yearly. The features of each plan, and any usage limits (such as Concierge questions or texts per month), are shown on our pricing page and in Settings → Billing. Each paid subscription period is one month or one year, depending on what you choose. Your subscription renews automatically for another period of the same length at the end of each period until you cancel or we end it under these Terms.
6.7 How to cancel. You may cancel at any time:
- (a) online, in Settings → Billing → Cancel subscription; or
- (b) by emailing admin@glamops.net from the Account Owner's email address.
Cancelling online takes effect right away (meaning your subscription will not renew). You do not need to speak to anyone. If we show you an offer to stay, a clear button to finish cancelling will be visible at the same time. We will email you a confirmation when you cancel.
6.8 Effect of cancellation. When you cancel, your subscription stays active until the end of the period you have already paid for, and then ends. After that, Section 13.5 (data export and deletion) applies. Cancelling a subscription does not delete your Account unless you also choose to delete it.
6.9 Refunds. Fees are charged in advance and are non-refundable. We do not give refunds or credits for partial months or years, unused time or unused features, except for the plan-change credits described in Section 6.12. These exceptions apply:
- (a) where the law requires a refund;
- (b) if we increase your price and you cancel within 14 days after the first charge at the new price, we will refund the unused part of that month on request (Section 6.11); and
- (c) if we terminate your subscription for convenience under Section 19.4, we will refund the unused part of any prepaid period; and
- (d) if you end these Terms after an unresolved objection to a new subprocessor under the DPA (Section 9.5), we will refund the unused part of any prepaid period.
6.10 Annual summary and yearly renewals. Once a year we will email the Account Owner a summary of your subscription, its price and how to cancel. For yearly plans, we will also email the Account Owner between 15 and 45 days before each yearly renewal, with the renewal date, the amount and how to cancel.
6.11 Price changes. We may change the subscription price. If we do, we will email the Account Owner at least 30 days before the change takes effect. The notice will state the new price, when it starts, and how to cancel. If you do not want to pay the new price, you may cancel before it takes effect. If you are charged the new price, you may still cancel within 14 days after that first charge and ask for a prorated refund for the rest of that month.
6.12 Changing plans. You can switch between Standard and Pro, or between monthly and yearly billing, at any time in Settings → Billing. Upgrades (Standard to Pro, or monthly to yearly on the same plan) take effect right away: we charge your payment method the prorated difference for the rest of your current billing period at that time, and if that charge is declined, nothing changes. Downgrades (Pro to Standard, or yearly to monthly) take effect at the start of your next billing period; until then you keep what you paid for, and you can call off a pending downgrade in Settings → Billing. Moving to Standard is only possible when your Account fits Standard's limits (for example, the number of Team Members). When you move to Standard, Pro-only features stop working, but the data you created with them is kept. During a trial nothing is charged, so a change of plan simply changes what will be charged when the trial ends.
6.13 Consent records. We keep records of your agreement to the automatic renewal terms, including the date and time, IP address, the version of the terms and the disclosure shown to you, for at least 3 years or 1 year after your subscription ends, whichever is longer.
7. Billing, payment and taxes
7.1 Payment method. We bill subscription fees through Stripe. You authorize us (and Stripe for us) to charge your payment method on file for all fees when due. You must keep a valid payment method on file while your subscription is active.
7.2 Taxes. Prices do not include taxes unless we say so. We will add sales, use or similar taxes where we are required to collect them, based on your billing address. If your business is exempt from a tax, you must give us valid exemption documentation; we will apply the exemption going forward once we accept it. You are responsible for any taxes other than taxes on our net income.
7.3 Failed payments. If a charge fails, we will retry it and email the Account Owner. You will have a grace period of 14 days to update your payment method. Our emails about failed payments will also explain how to cancel.
7.4 Pausing your Account. If payment is still not made after the grace period, or a trial ended without a plan being chosen (Section 6.3), we will pause your Account. While it is paused:
- (a) your Booking Site will stay live but new online bookings will be paused;
- (b) Messaging Features, AI Features and new payments will be turned off;
- (c) you will still be able to log in, pay the balance, export your Customer Data, and cancel; and
- (d) automatic reminders for appointments that are already booked will keep running.
Choosing a plan or paying ends the pause right away. If you have not paid or chosen a plan within 30 days after your Account was paused, we may end your subscription and Section 13.5 will apply.
7.5 Disputed charges. If you think we charged you in error, contact admin@glamops.net within 60 days of the charge. We will investigate in good faith. Please contact us before filing a chargeback with your card issuer.
7.6 Business information. You must give us accurate billing details, including your legal business name and billing address.
8. Promo codes for your GlamOps subscription
8.1 Our promo codes. We may offer promo codes or discounts on the GlamOps subscription. Each offer will state:
- (a) the discount and how long it lasts (for example, "50% off your first 3 months");
- (b) the price you will pay after the promotion ends;
- (c) when the code expires; and
- (d) who is eligible (for example, new Businesses only) and whether it can be combined with other offers.
8.2 Rules. Unless the offer says otherwise, promo codes: may be used once per Business; have no cash value; cannot be sold or transferred; and apply only to the subscription periods stated.
8.3 Notice before a promotion ends. If a promotional price lasts more than 31 days, we will email the Account Owner between 3 and 21 days before it ends, stating the regular price that will apply and how to cancel.
8.4 Misuse. We may cancel a promo code, or reverse a discount, if it was obtained or used fraudulently or in violation of the offer terms.
8.5 Your promo codes are different. Promo codes that you create for your own Clients are covered by Section 10.9, not this Section 8.
9. Client payments through Stripe
9.1 Stripe provides payment processing. Payment processing services for Businesses on GlamOps are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the "Stripe Services Agreement"), available at https://stripe.com/connect-account/legal. By agreeing to these Terms or continuing to use the payment features of the Services, you agree to be bound by the Stripe Services Agreement, as Stripe may change it from time to time. As a condition of GlamOps enabling payment processing through Stripe, you agree to give GlamOps accurate and complete information about you and your business, and you authorize GlamOps to share it and transaction information related to your use of the payment processing services provided by Stripe.
9.2 You must accept Stripe's terms. You must accept the Stripe Services Agreement to use payment features. Stripe will verify your identity and business, and may decline, limit, hold or close your Stripe account under its own terms. GlamOps does not control those decisions. Stripe's Privacy Policy is at https://stripe.com/privacy.
9.3 You are the merchant of record. For every payment a Client makes to you through the Services (including deposits, service payments, cancellation and no-show fees, tips, retail product sales and pay links):
- (a) you are the seller and the merchant of record;
- (b) the payment is made to your Stripe account, not to GlamOps; and
- (c) GlamOps never receives, holds or controls Client funds.
9.4 What GlamOps charges. GlamOps's subscription fee is billed to you separately (Section 7). GlamOps does not charge any fee on Client payments. GlamOps never takes any fee on tips. Stripe charges its own processing fees under the Stripe Services Agreement.
9.5 Your responsibilities for payments. You are solely responsible for:
- (a) refunds to your Clients, and your refund policy;
- (b) chargebacks and disputes, including responding to them and any resulting losses and fees;
- (c) deposits, cancellation fees and no-show fees you choose to charge, including making sure they are reasonable, clearly disclosed and accepted by the Client before booking;
- (d) tips, including paying tips to your employees or staff in full and on time, as required by federal and state wage laws;
- (e) taxes on your sales, including collecting and paying sales tax on retail products and any taxable services, and your own tax reporting;
- (f) surcharges or card fees you pass on to Clients, if the Services let you do so, including complying with card network rules and state laws that limit or ban them;
- (g) gift cards, prepaid packages and account credits, if you sell them, including state gift card, expiration, fee and unclaimed property laws; and
- (h) your own policies (refund, cancellation, deposit, product returns) and following them.
9.6 Saved cards. If you charge a Client's saved card later (for example, for a no-show fee or the balance after an appointment), you must have the Client's agreement to that type of charge, including when and how the amount will be set. The Services show your policy to the Client and record their acceptance, but you are responsible for the content of your policy and for charging only as it allows.
9.7 Tools, not advice. Features such as tax settings, deposit settings and policy templates are tools only. They are not legal or tax advice. You must check that your settings meet the laws that apply to you.
10. Your responsibilities as a Business
10.1 You run your business. You are solely responsible for your business and the services you provide to Clients, including their quality, safety and results, and for any injury, loss or claim that arises from them.
10.2 Licenses. You must hold, and keep current, every license, certification and permit required for your services and premises. In Oregon, this includes any authorization required by the Oregon Health Licensing Office (for example, an esthetics certification, a facility license, or advanced nonablative esthetics certification for services such as laser hair removal). In other states, it includes the licenses required by that state's licensing board. You must offer through the Services only services you are licensed and qualified to perform.
10.3 Intake and consent forms. You write and control the content of your intake, consent, waiver and other forms. Electronic signatures collected through the Services can be legally effective, but you are solely responsible for what your forms say, whether they are enforceable, and whether they meet the laws and professional rules that apply to you. Any sample forms or wording we provide are examples for convenience only, not legal advice. We recommend you have your forms reviewed by your own lawyer.
10.4 Health-related information. Your forms and notes may include information about a Client's health (for example, allergies, medications, skin conditions or pregnancy). You must:
- (a) collect only what you need for your services;
- (b) give Clients any notices, and obtain any consents, that the law requires for health-related information. In some states this includes separate, opt-in consent to collect and to share consumer health data (for example, under Washington's My Health My Data Act); and
- (c) use the consent and privacy tools in the Services as directed.
10.5 Not for HIPAA-covered information. The Services are not designed for "protected health information" under HIPAA. If you are a HIPAA covered entity (for example, a medical practice that bills health insurance electronically), you may not use the Services to store protected health information unless we have signed a business associate agreement with you. GlamOps does not currently offer business associate agreements.
10.6 Policies you set. You decide your own cancellation, late, no-show, deposit, refund and booking policies. You must state them clearly on your Booking Site and in the booking flow, and you must apply them as stated.
10.7 Laws that apply to you. You must comply with all laws that apply to your business and your use of the Services, including consumer protection, advertising, privacy, data security, marketing, employment and wage, tax, accessibility and licensing laws.
10.8 Notices to your Clients. You must give your Clients any privacy notice and other notices the law requires about how you collect and use their information. GlamOps provides a template Client privacy notice that you may adopt and adapt.
10.9 Promo codes, reviews and advertising you create. You are responsible for promo codes and offers you create for Clients (including their terms and expiration), for reviews or testimonials you collect or display, and for every claim you make in your Business Content and messages. You must not post fake reviews, buy positive reviews or hide negative reviews, and your claims must be truthful and supported.
10.10 Minors. If you serve Clients under 18, a parent or legal guardian must complete and sign the Client's intake and consent forms where the law requires it. You may not use a minor's information for targeted advertising.
10.11 Accessibility of your content. We make commercially reasonable efforts to design GlamOps-provided Booking Site templates to meet WCAG 2.1 Level AA. You are responsible for the accessibility of content you add, including image descriptions (alt text), video captions, color choices and documents you upload.
10.12 Data you import. If you import data from other software (for example, files you export from another booking provider), you confirm that you have the right to import it, and that the data was collected lawfully. You must obtain the files yourself. You must not give GlamOps your login credentials for another provider, and GlamOps will not access another provider's systems for you. Text-message consent does not carry over with imported data (Section 11.5).
11. Messaging: email, text messages and reminders
11.1 How messaging works. The Messaging Features let you send emails and text messages to your Clients, including campaigns and automatic appointment reminders. We send email using a third-party email provider (Resend) and text messages using a third-party telecommunications provider (Twilio). Text messaging is not yet available. The text-message parts of this Section will apply when it launches.
11.2 You are the sender. You decide who receives your messages, what they say and when they are sent. Messages are sent in your business's name. You are responsible for your messages and for complying with all laws that apply to them, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), state telemarketing and text-message laws, and state email laws.
11.3 Toll-free numbers and verification. To send text messages, GlamOps will obtain a toll-free number for your business and submit it to the carriers for verification on your behalf. You authorize us to do this and to share your business information for that purpose, including your legal business name (exactly as on your IRS records), EIN (or sole proprietor status), business address, website, contact details, privacy policy and terms URLs, and sample messages. You confirm this information is accurate. The number is assigned for use with the Services and is not transferable to you. If your Account ends, the number may be released. Carriers may approve, reject or limit your number. We do not control their decisions.
11.4 Consent you must have. You must have each recipient's consent before you send messages, as follows:
- (a) Marketing text messages: the recipient's prior express written consent, specific to your business. The Services collect this with a checkbox and a "YES" reply confirmation (double opt-in). You may not get around this process.
- (b) Appointment reminders and other informational texts: at least the recipient's prior express consent to receive texts from your business at that number.
- (c) Marketing emails: you may send only to Clients who have opted in to receive marketing email from your business (for example, by checking the email opt-in box when booking or in the Client Portal), and every marketing email must include a working unsubscribe link (we add it automatically).
11.5 Imported contacts. Contacts you import are never subscribed to text messages. They must opt in through the Services' consent process before you can text them. Imported contacts are not subscribed to marketing email unless they opt in.
11.6 No purchased lists. You must not send messages to purchased, rented, scraped or shared lists, or to anyone who has not given you their contact details directly.
11.7 Opt-outs. The Services automatically stop messages to a recipient who opts out (for example, by replying STOP or clicking unsubscribe). You must not re-subscribe, re-add or otherwise message a person who has opted out unless they opt in again themselves. If a Client asks you to stop messages in any other way (in person, by phone, by email or in a reply), you must record their opt-out in the Services right away. An opt-out from texts applies to all text messages from your business, including reminders, unless and until the Client opts in again.
11.8 Message content. Your messages must:
- (a) identify your business;
- (b) be truthful, including subject lines and preview text (for example, don't say "today only" for a sale that will run longer);
- (c) in marketing emails, include a valid physical postal address for your business, which may be a registered P.O. box or private mailbox; and
- (d) follow the Acceptable Use Policy, including the ban on sex, hate, alcohol, firearms, tobacco, cannabis and drug content in text messages.
Appointment reminders and booking confirmations must not contain promotional content. Adding promotions can turn them into marketing messages that require marketing consent.
11.9 Sending limits and quiet hours. To help you follow state laws, the Services apply sending rules to marketing text messages, which you may not get around. They include:
- (a) sending only between 9:00 a.m. and 8:00 p.m. in the recipient's local time, with the Sunday, holiday and state-specific rules described in the Messaging Terms (Part B, Section B4);
- (b) a limit of 1 marketing text per recipient per day, and 4 per month; and
- (c) other limits we set from time to time.
These rules are a safety net, not legal advice. You remain responsible for complying with the laws that apply to your messages, including any registration a state requires.
11.10 Consent and opt-out records. The Services keep records of consents and opt-outs for your business, including the date and time, the method, the consent wording shown and the reply confirming consent. You agree that these records are the system of record for your Messaging Features. We keep consent records for at least 5 years after the last message sent in reliance on them (longer if a claim is pending) and opt-out records for at least 10 years, including after your Account ends, so opted-out people are not messaged again.
11.11 Our rights. To protect recipients, carriers, our providers and other Businesses, we may at any time, with or without notice:
- (a) review messages and consent records;
- (b) delay, throttle, block or refuse to send any message;
- (c) suspend your Messaging Features or your number, for example after complaints, high bounce or spam rates, a carrier or provider notice, or a suspected violation;
- (d) give consent records and related information to carriers, our messaging providers, or authorities when they request it or when we believe it is required; and
- (e) require you to confirm or re-collect consent.
11.12 Provider policies. You must comply with the messaging policies of our providers as they apply to your messages, including Twilio's Messaging Policy and Acceptable Use Policy and Resend's Acceptable Use Policy. A summary of the key rules is in our Acceptable Use Policy.
11.13 Push notifications. If you use the GlamOps mobile apps, we may send you operational push notifications (for example, new bookings). We will send promotional push notifications only if you opt in, and you can opt out in the app.
12. AI Features
12.1 What Concierge does. Concierge is an assistant that answers questions about your business. It is powered by Claude, an AI model provided by Anthropic, PBC ("Anthropic"). It has read-only access to your Account's Customer Data. It cannot change your data, send messages or take payments.
12.2 Your data and the AI provider. When you or a Team Member uses Concierge, your question and the Customer Data needed to answer it (which may include Client names, notes and appointment history) are sent to Anthropic to generate the answer. Anthropic acts as our subprocessor under the DPA. Under its commercial terms, Anthropic does not train its models on this data. Anthropic deletes it within 30 days by default, except that content flagged for violating its usage policies may be kept longer (up to 2 years). By default, Concierge does not send intake or health form answers or Client photos to Anthropic. We do not keep a copy of your questions or Concierge's answers; we count questions per month to apply the limit.
12.3 Turning it on and off. The AI Features are off until the Account Owner turns them on for the Business and agrees to the sharing described in Section 12.2. Only Team Members with the owner or manager role can use Concierge. Each Team Member must also agree on a first-use consent screen before their own first use. The Account Owner can turn the AI Features off for the whole Business, and each Team Member can turn them off for themselves, at any time in Settings → Concierge.
12.4 Answers can be wrong. AI output may be inaccurate, incomplete, outdated or inconsistent, even when it sounds confident. You must check any AI answer independently before you rely on it, especially for numbers, money, dates and anything about a Client.
12.5 No medical or professional advice. The AI Features are not designed to give, and must not be used for, medical advice, diagnosis of skin or health conditions, or treatment recommendations. They also do not give legal, tax or financial advice. Decisions about your services and your Clients' care are yours alone, using your own professional judgment.
12.6 Your responsibility for AI output. You are responsible for how you use AI output. If you copy AI output into your Booking Site, messages, forms or anything else, it becomes your Business Content, and you are responsible for checking and approving it.
12.7 Plan and limits. Concierge is part of the Pro plan. Each Account may ask up to 100 questions per calendar month, or another limit we show in the Services. We may change limits, or limit or suspend the AI Features to prevent abuse or manage cost and performance.
12.8 Acceptable use. You must use the AI Features in line with the Acceptable Use Policy, including Anthropic's usage policy as it applies to you. You must not try to make the AI Features reveal other Businesses' data, our system instructions or other internal information.
12.9 Changes. AI technology changes quickly. We may change the AI model, the provider or how the AI Features work. If we add a new AI provider that will receive Customer Data, we will update our subprocessor list as described in the DPA.
13. Customer Data
13.1 You own your Customer Data. As between you and GlamOps, you own your Customer Data. We do not claim ownership of it.
13.2 Our permission to use Customer Data. You give GlamOps a worldwide, non-exclusive, royalty-free license, for as long as we provide the Services to you (and after that only as Section 13.5 allows), to host, store, copy, process, transmit, display and adapt Customer Data. We use this license only to:
- (a) provide, maintain, secure and support the Services for you;
- (b) prevent fraud and abuse, and enforce these Terms;
- (c) follow your instructions (including instructions given through your settings); and
- (d) comply with the law.
This includes publishing Business Content on your Booking Site and sharing Customer Data with our subprocessors as described in the DPA.
13.3 What we don't do with Customer Data. We do not sell Customer Data. We do not use Client personal information for our own marketing or to target advertising. We do not combine Client data across Businesses to build profiles. We do not use Customer Data to train, fine-tune or improve any artificial intelligence or machine learning model, and we do not let our subprocessors do so (DPA Section 6.5).
13.4 Aggregated Data and Usage Data. We may create Aggregated Data from Customer Data and use it, and Usage Data, to operate, analyze and improve the Services (for example, measuring how many appointments are booked across the Platform). Aggregated Data will not identify you, your Team Members or your Clients. We will not try to re-identify it. We do not create Aggregated Data from intake or health form answers (DPA Section 6.7).
13.5 Export and deletion.
- (a) Export at any time. While your Account is active, you can export your Customer Data in CSV format from Settings → Export.
- (b) 30-day export window. After your subscription ends or your Account is closed for any reason, we will keep your Customer Data for 30 days so you can log in and export it. During that time your Account will be read-only, and your Booking Site and Messaging Features will be off. If your Account was terminated for a serious violation, we may provide your export by other means instead of login access.
- (c) Deletion. After the 30-day window, we will delete your Customer Data from our active systems within 30 days, and from backups within 35 days as backups expire.
- (d) What we keep. We may keep: (i) consent and opt-out records (Section 11.10); (ii) billing, tax and transaction records we must keep by law; (iii) records relevant to a legal claim, investigation or legal hold; and (iv) Aggregated Data. Kept data stays subject to our confidentiality and security duties.
- (e) Stripe holds its own records. Your Stripe account and payment records are held by Stripe under the Stripe Services Agreement and are not deleted by closing your GlamOps Account.
- (f) Immediate deletion. If you delete your Account and choose to delete your data immediately, the 30-day window will not apply.
13.6 Client requests. Clients may contact you, or us, to access, correct or delete their information. We will send requests we receive to you, and help you respond as described in the DPA. You are responsible for responding to your Clients.
13.7 Data Processing Addendum. The DPA is part of these Terms. It describes how we process personal information in Customer Data on your behalf as your service provider and processor, including security, subprocessors, breach notice, and help with Client requests.
13.8 Security. We maintain reasonable administrative, technical and physical safeguards designed to protect Customer Data, as described in the DPA. No system is perfectly secure, and you are responsible for your own security practices (Section 5.4).
13.9 Backups are not a substitute. We back up the Services, but you should keep your own copies of important Customer Data by exporting it regularly.
14. Booking Sites and Client-facing features
14.1 Your Booking Site. We host your Booking Site at a glamops.net subdomain you choose or at a custom domain you connect. Your Booking Site shows your Business Content and lets Clients book, pay, sign forms and use the Client Portal.
14.2 Subdomains. You don't own your glamops.net subdomain. We may refuse or reclaim a subdomain that is misleading, infringes someone's rights or is inactive.
14.3 Custom domains. If you connect your own domain, you are responsible for registering it, keeping it renewed, configuring DNS correctly, and having the right to use it. Your domain registrar's terms apply to the domain.
14.4 Client-facing terms. Your Booking Site and Client Portal will show Clients the GlamOps Booking Terms for Clients (at https://glamops.net/legal/booking-terms) and your own policies. They explain that you, not GlamOps, provide the services and set the policies. You may not remove or hide these notices.
14.5 Site analytics. The Services provide first-party visit analytics for your Booking Site. You may not add third-party analytics, advertising pixels, session recording or similar tracking tools to your Booking Site, Client Portal, intake forms or payment pages.
15. Content, intellectual property and copyright
15.1 Your content. You keep all rights in your Business Content. You give us the license in Section 13.2 to host and display it.
15.2 Your promises about content. You confirm that you have all rights needed to upload and use your Business Content (including photos of Clients, which require the Client's permission), and that it does not infringe anyone's rights or break the law or the Acceptable Use Policy.
15.3 Our rights. GlamOps and its licensors own the Services, including all software, designs, templates, text, graphics, logos and the "GlamOps" name, and all related intellectual property rights. Except for the limited rights in these Terms, we do not give you any rights in the Services.
15.4 Your license to use the Services. Subject to these Terms and your payment of fees, we give you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right during your subscription for you and your Team Members to use the Services for your internal business purposes.
15.5 Restrictions. You may not, and may not let anyone else: copy, modify or create derivative works of the Services; reverse engineer, decompile or try to discover source code, except to the extent the law allows despite this restriction; resell, rent or sublicense the Services; use the Services to build a competing product; remove our proprietary notices; or use the Services except as these Terms and the Acceptable Use Policy allow.
15.6 Feedback. If you give us ideas, suggestions or feedback, we may use them freely without paying you or giving you credit. You do not have to give us feedback.
15.7 Copyright complaints (DMCA). We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. Our designated agent is:
- GlamOps LLC, Attn: Copyright Agent
- 11918 SE Division Street #2046, Portland, OR 97266
- Email: admin@glamops.net
- Phone: (971) 274-1392
A notice must be in writing and include: (a) a physical or electronic signature of the copyright owner or a person authorized to act for them; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (for example, the URL); (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and (f) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.
15.8 Takedowns and counter-notices. When we receive a valid notice, we may remove or disable the material and will tell the affected Business. A Business that believes the material was removed by mistake may send a counter-notice to our agent, as the DMCA provides. We may restore the material as the DMCA allows.
15.9 Repeat infringers. We will, in appropriate circumstances, terminate the Accounts of Businesses that are repeat infringers, as described in our Copyright and DMCA Policy at https://glamops.net/legal/copyright.
16. Third-Party Services
16.1 Third-Party Services. The Services work with Third-Party Services, including Stripe, our email and text providers, Anthropic, app stores, map and calendar services, and domain registrars. Your use of a Third-Party Service may be subject to that provider's own terms and privacy policy.
16.2 No responsibility for Third-Party Services. We do not control Third-Party Services and are not responsible for them, including their availability, security, decisions (such as Stripe declining or holding funds, or a carrier rejecting a number) or changes. If a Third-Party Service changes or stops working with the Services, we may change or stop the related feature.
16.3 Your authorization. If you connect a Third-Party Service to the Services, you authorize us to exchange data with it as needed to provide the connection.
16.4 Other trademarks. Names of other companies and products mentioned in the Services (for example, other booking software) are trademarks of their owners. GlamOps is not affiliated with or endorsed by them.
17. Beta features
We may offer features labeled "beta," "preview," "early access" or similar ("Beta Features"). Beta Features are optional, may not work correctly, may change or be removed at any time, and are provided "as is" without any warranty or support commitment. Our liability for Beta Features is limited as described in Section 22, and in any case to $50.
18. Availability, support and changes to the Services
18.1 Availability. We work to keep the Services available, but we do not promise any specific uptime and we do not offer a service level agreement. The Services may be unavailable because of maintenance, updates, Third-Party Service problems, internet problems or events beyond our control.
18.2 Maintenance. We will try to schedule planned maintenance at low-traffic times and to give notice in advance where practical.
18.3 Support. We provide support by email at admin@glamops.net, during business hours, Pacific time. We don't guarantee response times.
18.4 Changes to the Services. We may add, change or remove features. If we remove a major feature that you are paying for, we will give you at least 30 days' notice where practical, and you may cancel.
19. Suspension and termination
19.1 You may end these Terms by cancelling your subscription (Section 6.7) and deleting your Account, or by deleting your Account.
19.2 Suspension. We may suspend all or part of the Services for you (for example, only Messaging Features), with notice where practical, if:
- (a) you breach these Terms or the Acceptable Use Policy, or we reasonably suspect a breach;
- (b) your use creates a security risk, legal risk or harm to us, other Businesses, Clients, message recipients or Third-Party Services;
- (c) a carrier, Stripe or another provider requires it;
- (d) you don't pay fees when due (Section 7.4); or
- (e) the law or a government request requires it.
We will try to limit any suspension to what is reasonably needed, and to restore the Services when the problem is fixed.
19.3 Termination for cause. We may terminate your Account and these Terms by notice if:
- (a) you materially breach these Terms and do not fix the breach within 10 days after notice (if it can be fixed);
- (b) you commit a serious or repeated breach of the Acceptable Use Policy, including sending messages without consent;
- (c) you operate without a required license, or we reasonably believe your business is illegal; or
- (d) you become insolvent or stop operating your business.
19.4 Termination for convenience. We may stop providing the Services to you, or stop offering the Services entirely, with at least 30 days' notice. In that case we will refund any prepaid fees for the period after termination.
19.5 Effect of termination. When these Terms end: your right to use the Services ends; you must pay any fees owed; Section 13.5 applies to your Customer Data; your Booking Site will go offline; and your toll-free number may be released. Sections that by their nature should survive will survive, including Sections 2, 6.13, 9.5, 11.10, 13.3 to 13.5, 15.3, 15.5, 15.6, 20 to 26.
20. Confidentiality
20.1 What is confidential. "Confidential Information" means non-public information that one party shares with the other and that is marked confidential or that a reasonable person would understand to be confidential. Your Customer Data is your Confidential Information. Non-public information about the Services, our pricing plans not yet released, and our security practices is our Confidential Information.
20.2 What is not confidential. Confidential Information does not include information that: is or becomes public without the receiving party's fault; the receiving party already knew without a duty of confidentiality; the receiving party gets lawfully from someone else without a duty of confidentiality; or the receiving party develops independently.
20.3 Duties. The receiving party will use the other party's Confidential Information only to perform under these Terms, protect it with at least reasonable care, and share it only with its personnel, contractors and service providers who need to know it and are bound by similar duties.
20.4 Required disclosure. A party may disclose Confidential Information if required by law or court order, after giving the other party prompt notice (if allowed) so it can seek protection.
21. Disclaimer of warranties
21.1 "As is." TO THE FULLEST EXTENT ALLOWED BY LAW, THE SERVICES (INCLUDING AI FEATURES, BETA FEATURES, TEMPLATES AND SAMPLE FORMS) ARE PROVIDED "AS IS" AND "AS AVAILABLE." GLAMOPS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY.
21.2 No guarantees. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE; THAT DATA WILL NEVER BE LOST; THAT DOUBLE BOOKINGS WILL NEVER HAPPEN; THAT MESSAGES WILL BE DELIVERED; THAT CARRIERS OR STRIPE WILL APPROVE YOU; THAT AI OUTPUT WILL BE ACCURATE; OR THAT THE SERVICES WILL MEET YOUR LEGAL OBLIGATIONS. COMPLIANCE TOOLS (SUCH AS QUIET HOURS, CONSENT FLOWS AND TAX SETTINGS) ARE AIDS, NOT A GUARANTEE OF LEGAL COMPLIANCE.
21.3 No professional advice. Nothing in the Services is legal, tax, medical or financial advice.
22. Limitation of liability
22.1 No indirect damages. TO THE FULLEST EXTENT ALLOWED BY LAW, NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BOOKINGS, LOSS OF GOODWILL, OR LOSS OR CORRUPTION OF DATA, EVEN IF IT WAS TOLD THEY WERE POSSIBLE.
22.2 Cap. TO THE FULLEST EXTENT ALLOWED BY LAW, EACH PARTY'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, FOR ALL CLAIMS TOGETHER, WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO GLAMOPS FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) $100.
22.3 Exceptions. Sections 22.1 and 22.2 do not limit:
- (a) your obligation to pay fees;
- (b) your indemnity obligations under Section 23;
- (c) your liability for breach of Section 11 (Messaging) or the Acceptable Use Policy;
- (d) either party's liability for infringing or misappropriating the other party's intellectual property;
- (e) either party's liability for fraud, gross negligence or willful misconduct; or
- (f) any liability that cannot be limited by law.
22.4 Basis of the bargain. These limits are an essential part of the deal between us. The price of the Services reflects them, and they apply even if a remedy fails of its essential purpose.
23. Indemnification
23.1 You will defend us. You will defend GlamOps and its members, managers, employees, contractors and agents (the "GlamOps Parties") against any claim, demand, lawsuit, investigation or proceeding brought by a third party (including a Client, message recipient, Team Member, carrier, payment network, or government authority) arising out of or relating to:
- (a) the services, products or treatments you provide, including any injury or damage they cause;
- (b) your Business Content, forms, policies or AI output you use;
- (c) your messages, including any claim that they were sent without required consent, at prohibited times, or with misleading content, or under the TCPA, CAN-SPAM or state telemarketing, text or email laws;
- (d) your Client payments, including refunds, chargebacks, disputes, deposits, cancellation and no-show fees, tips, surcharges, gift cards and taxes on your sales;
- (e) your lack of any required license, certification or permit;
- (f) your collection or use of Client information, including health-related information, in violation of law or of your notices to Clients;
- (g) data you import or upload without the right to do so;
- (h) your Team Members' acts or omissions; or
- (i) your breach of these Terms, the Acceptable Use Policy or the law.
23.2 You will pay. You will pay any damages, fines, penalties, settlements and reasonable legal fees and costs that the GlamOps Parties incur from these claims.
23.3 Process. We will tell you promptly about a claim (a delay only reduces your duty to the extent it harms you), give you reasonable help at your expense, and let you control the defense. You may not settle a claim in a way that admits fault for, or imposes an obligation on, a GlamOps Party without our written consent. We may take part in the defense with our own lawyer at our own cost. If you fail to defend a claim, we may defend it and you will pay our costs.
24. Dispute resolution and class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS HOW DISPUTES ARE RESOLVED.
24.1 Talk to us first. Before starting a court case, the party with the dispute must send the other a written notice describing the dispute and the relief sought. Notices to GlamOps go to admin@glamops.net and to our mailing address (11918 SE Division Street #2046, Portland, OR 97266). Notices to you go to the Account Owner's email. The parties will try in good faith to resolve the dispute informally for 60 days after the notice is received, including by a phone or video call if either party asks. Deadlines to bring claims are paused during this period.
24.2 Small claims court. Either party may bring an individual claim in small claims court in Multnomah County, Oregon or the county where your business is located, if the claim qualifies and stays there on an individual basis.
24.3 Courts. Except for claims brought in small claims court under Section 24.2, any dispute arising out of or relating to these Terms or the Services will be decided exclusively by the state or federal courts located in Multnomah County, Oregon, and each party consents to their personal jurisdiction. Each party waives any right to a jury trial, and claims may be brought only on an individual basis and not as part of a class or representative action, to the extent the law allows.
24.4 Time limit. Any claim must be brought within one year after it arises, unless the law does not allow this limit.
24.5 Changes to this Section. If we change this Section 24, the change will not apply to a dispute we already knew about before the change. You may reject a material change to this Section by emailing admin@glamops.net within 30 days after we give notice of it; the previous version will then continue to apply to you.
25. Changes to these Terms
25.1 We may update these Terms. We may change these Terms from time to time. We will post the new version with a new "Last updated" date and version number.
25.2 Material changes. For a material change (for example, a change to fees, cancellation, liability, data use or dispute resolution), we will:
- (a) email the Account Owner at least 30 days before the change takes effect, unless a shorter period is needed to comply with law or to address a security or abuse risk; and
- (b) ask you to accept the updated Terms in the Services (for example, with a checkbox and an "I agree" button).
We record your acceptance of each version as described in Section 3.2.
25.3 If you don't agree. If you don't accept a material change, you may cancel before it takes effect, and the previous version will apply until your subscription ends. We may require you to accept the updated Terms to keep using the Services after the change takes effect or after your current paid period ends.
25.4 Other changes. Changes that are not material (for example, clarifications, typo fixes, or new features) take effect when posted.
26. Mobile apps and app stores
26.1 The GlamOps apps. GlamOps mobile apps for iOS and Android are part of the Services and are offered free to Businesses with an Account. Subscriptions are purchased on the GlamOps website, not inside the apps.
26.2 App store terms. Your use of an app is also subject to the terms of the app store you downloaded it from (for example, the Apple App Store or Google Play). If those terms conflict with these Terms on how you may use the app, the app store terms control for that topic.
26.3 Additional terms for apps downloaded from the Apple App Store. If you downloaded a GlamOps app from the Apple App Store, the following also applies:
- (a) Parties. These Terms are between you and GlamOps only, not Apple Inc. ("Apple"). GlamOps, not Apple, is solely responsible for the app and its content.
- (b) Scope of license. Your license to use the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- (c) Maintenance and support. GlamOps is solely responsible for providing maintenance and support for the app, as described in these Terms or as required by law. Apple has no obligation to provide any maintenance or support services for the app.
- (d) Warranty. GlamOps is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you. To the maximum extent allowed by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are GlamOps's responsibility, to the extent not disclaimed in these Terms.
- (e) Product claims. GlamOps, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims under consumer protection, privacy or similar laws.
- (f) Intellectual property claims. If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, GlamOps, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- (g) Legal compliance. You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- (h) Contact. Questions, complaints or claims about the app should be sent to GlamOps at the contact details in Section 28.
- (i) Third-party terms. You must comply with any applicable third-party terms (such as your wireless data service agreement) when using the app.
27. General terms
27.1 Governing law. Oregon law governs these Terms, without regard to its conflict-of-laws rules.
27.2 Entire agreement. These Terms (including the documents in Section 1.5) are the entire agreement between you and GlamOps about the Services. They replace any earlier agreements or statements on the same subject. Terms in any purchase order or other document you send us do not apply.
27.3 Electronic communications. You agree to receive notices, agreements, disclosures and other communications from us electronically, by email to the Account Owner or in the Services. Electronic communications satisfy any legal requirement that a communication be in writing. You are responsible for keeping the Account Owner's email address current.
27.4 Notices to us. Legal notices to GlamOps must be sent to admin@glamops.net with a copy by mail to GlamOps LLC, 11918 SE Division Street #2046, Portland, OR 97266.
27.5 Assignment. You may not assign or transfer these Terms or your Account without our written consent. We may assign these Terms, without your consent, to an affiliate or to a successor in a merger, acquisition or sale of all or substantially all of the relevant business or assets, if we give you notice.
27.6 Independent parties. You and GlamOps are independent contractors. These Terms do not create a partnership, joint venture, employment or agency relationship.
27.7 No third-party beneficiaries. No one other than you and GlamOps has rights under these Terms, except the GlamOps Parties under Section 23 and Apple under Section 26.3. Clients and Team Members are not third-party beneficiaries.
27.8 Force majeure. Neither party is responsible for delay or failure to perform (other than payment obligations) caused by events beyond its reasonable control, such as natural disasters, power or internet failures, failures of Third-Party Services, labor disputes, war, terrorism, government action or pandemics.
27.9 Severability. If any part of these Terms is found unenforceable, it will be changed only as much as needed to make it enforceable, and the rest of these Terms will stay in effect.
27.10 No waiver. Failing to enforce a right is not a waiver of it. A waiver must be in writing.
27.11 Export and sanctions. You will not use, export or allow access to the Services in violation of U.S. export control or sanctions laws.
27.12 Interpretation. Headings are for convenience only. "Including" means "including without limitation." These Terms will not be read against either party because that party drafted them.
27.13 Survival. Sections that by their nature should continue after these Terms end will continue (see Section 19.5).
