These Booking Terms apply when you book an appointment, pay, fill out a form, or use the "My appointments" Client Portal on a Booking Site powered by GlamOps. Please read them. They include a limit on GlamOps's liability (Section 13) and explain how disputes work (Section 15).
1. Who we are and who these terms are with
1.1 GlamOps. "GlamOps," "we," and "us" mean GlamOps LLC, an Oregon limited liability company. GlamOps makes booking, payment, form, and messaging software for independent beauty professionals.
1.2 The Business. The "Business" is the esthetician or beauty business whose Booking Site you are using (a "Business" as defined in the GlamOps Terms of Service at https://glamops.net/legal/terms). Its name is shown at the top of the Booking Site and on your confirmation. In these terms, "Business Name" means that Business.
1.3 You. "You" means the person booking, using the Client Portal, or filling out a form (a "Client" of the Business). If you book for someone else (for example, your child), you agree to these terms for yourself and on their behalf, and you confirm you have the right to do so.
1.4 Agreement. By booking, paying, signing a form, or creating a Client Portal account, and by checking the box or pressing the button that says you agree, you accept these Booking Terms. If you do not agree, do not use the Booking Site.
2. GlamOps provides the technology; the Business provides the services
2.1 GlamOps is a software provider. GlamOps provides the technology the Business uses to take bookings, collect payments, send messages, and manage forms. GlamOps does not provide beauty, skin care, or any other services, and does not employ, supervise, or recommend the Business.
2.2 The Business is responsible for its services. The Business alone is responsible for:
- (a) the services it provides, including their quality, safety, and results;
- (b) holding any licenses, certifications, and permits it needs;
- (c) its prices, deposits, fees, and any taxes;
- (d) its cancellation, no-show, late arrival, refund, and rescheduling policies;
- (e) the content of its intake and consent forms and any waivers;
- (f) health and safety at its location, including deciding whether a service is right for you; and
- (g) the messages it sends you.
2.3 GlamOps is not a party to your agreement with the Business. Your purchase of services is a contract between you and the Business only. GlamOps does not guarantee that the Business will provide the services, honor its policies, or issue refunds.
2.4 Health information is not medical advice. Nothing on the Booking Site, in a form, or in a message is medical advice from GlamOps. If you have a medical condition, allergy, or concern, talk to the Business and, where appropriate, a licensed health care provider before your appointment.
3. Booking
3.1 Accurate information. You agree to give accurate and complete information when you book, including your name, email, and mobile number, and to keep it up to date.
3.2 Age. You must be at least 18 years old to book for yourself or create a Client Portal account. A parent or legal guardian must book for, and complete any forms for, anyone under 18.
3.3 Confirmation. A booking is confirmed only when you receive a confirmation from the Business by email (or text, if you have opted in). The Business may decline or cancel a booking, for example if a service is not suitable for you, under its own policies.
3.4 Availability. GlamOps works to show accurate availability, but does not guarantee that a time shown will be available. If a conflict happens, the Business will contact you to reschedule.
4. Payments
4.1 Stripe processes payments for the Business. Payments on GlamOps Booking Sites are processed by Stripe, Inc. and its affiliates ("Stripe") on behalf of the Business. The Business is the merchant of record. Your card statement will show the Business's name or descriptor. GlamOps does not receive or hold your payment and does not store your full card number. Stripe's privacy policy is at https://stripe.com/privacy.
4.2 What you may be asked to pay. Depending on the Business's settings, you may be asked to pay:
- (a) a deposit when you book;
- (b) the balance for your services, before, at, or after your appointment;
- (c) a cancellation, late cancellation, or no-show fee, if the Business's policy allows it and you agreed to it;
- (d) an optional tip; and
- (e) any taxes the Business charges.
All amounts are shown before you pay.
4.3 Deposits. Whether a deposit is refundable, and whether it is applied to your balance, is set by the Business's policy, which is shown in full before you book.
4.4 Tips. Tips are optional. A tip you add is part of the amount you authorize and is paid to the Business. GlamOps does not take any fee from tips.
4.5 Refunds and payment questions. Refunds are decided and issued by the Business under its policy. If you have a question about a charge, contact the Business first. You may also have rights with your card issuer.
4.6 Surcharges. GlamOps Booking Sites do not add card surcharges.
5. Cancellation and no-show policies
5.1 The Business's policy applies. Each Business sets its own cancellation, late cancellation, late arrival, and no-show policy (the "Cancellation Policy"). The full Cancellation Policy is shown on the booking page before you book, and is included in your confirmation email.
5.2 Your agreement. Before you can book, you will be asked to check a box confirming you have read and agree to the Business's Cancellation Policy. That agreement is between you and the Business.
5.3 How to cancel. You can cancel or reschedule through the link in your confirmation email, in the Client Portal, or by contacting the Business directly, within the time the Cancellation Policy allows.
5.4 Records. GlamOps keeps a record, on the Business's behalf, of the Cancellation Policy you were shown and when you agreed to it (date, time, IP address, and the version of the policy). The Business may use this record if you dispute a charge.
6. Saving your card for fees (card on file)
6.1 When it applies. Some Businesses require you to save a card when you book, so they can charge fees allowed by their Cancellation Policy. If so, the booking page will say so and ask for your authorization before you book.
6.2 What you authorize. If you save a card, you authorize the Business, through Stripe, to securely store your card and to charge it later without you being present, only for:
- (a) a late cancellation or no-show fee in the amount set out in the Cancellation Policy you accepted; and
- (b) the unpaid balance for services you received, if you did not pay at your appointment.
6.3 Timing and amount. A charge under 6.2 will be made only after the event that triggers it (for example, after a missed appointment), usually within 7 days. The amount will be the amount stated in the policy, or calculated as the policy describes (for example, 50% of the booked service price). The Business will send you an email receipt for any charge.
6.4 How long the card is saved, and how to remove it. Your card stays saved until you remove it in the Client Portal or ask the Business to remove it. You cannot remove a card while you have an upcoming appointment that requires one, unless you cancel the appointment or add another card.
6.5 Disputes. If you think a charge is wrong, contact the Business first.
7. Intake and consent forms; electronic signatures
7.1 The Business writes its forms. The Business may ask you to fill out intake, health history, consent, release, or photo-consent forms. The Business writes these forms and decides what to ask. GlamOps does not review them and is not responsible for their content or legal effect.
7.2 Answer honestly. The Business may rely on your answers to decide whether a service is safe for you. Tell the Business before your appointment if anything changes.
7.3 Health information. Your answers may include health information, such as allergies, medications, skin conditions, or pregnancy. This is handled under the Business's privacy notice and consumer health data privacy policy and GlamOps's Consumer Health Data Privacy Policy. Where the law requires it, you will be asked for separate consent before health information is collected or shared.
7.4 Consent to electronic records and signatures. By checking the consent box on a form and signing it electronically, you agree that:
- (a) you are using electronic records and an electronic signature instead of paper and ink;
- (b) your electronic signature (typed name, drawn signature, or checkbox and button) has the same effect as a handwritten signature;
- (c) you can get a copy of each signed form by email and in the Client Portal, and you can download or print it;
- (d) you can ask the Business for a paper copy at no charge;
- (e) you can withdraw your consent to electronic records at any time by telling the Business, which will then provide paper forms. Withdrawing does not affect forms you already signed; and
- (f) to view and keep these records you need a device with a current web browser, an email address, and the ability to open PDF files. If these requirements change in a way that affects your access, you will be told.
7.5 Signature record. For each signed form, GlamOps records, on the Business's behalf, your name, the date and time, your IP address and device information, the version of the form, and a digital fingerprint of the signed document, to show it has not been changed.
8. Client Portal ("My appointments")
8.1 Your account. You can sign in to the Client Portal to see your appointments, forms, receipts, and saved cards, and to manage your message preferences.
8.2 Keep it secure. Keep your login details private. You are responsible for activity under your account. Tell the Business or GlamOps at admin@glamops.net if you think someone has accessed your account.
8.3 One Business. Your Client Portal account is linked to the Business whose site you used. If you book with another Business on GlamOps, you will have a separate account with that Business.
8.4 Closing your account. You can ask to close your Client Portal account in the portal or by contacting the Business. The Business may keep records of your appointments, payments, and signed forms as its policy and the law allow.
9. Messages from the Business
9.1 Appointment messages. When you book, the Business will send you messages about your appointment, such as confirmations, reminders, changes, receipts, and form requests, by email. These are part of the service you asked for.
9.2 Marketing emails. The Business may send you marketing emails (for example, offers and news) only if you opted in, for example by checking the email box when you book or in the Client Portal. Every marketing email includes an unsubscribe link and the Business's postal address. You can unsubscribe at any time. GlamOps processes unsubscribes immediately, and in any case within 7 days. Unsubscribing from marketing does not stop appointment messages.
9.3 Text messages. The Business will send you text messages only if you opt in, by checking the text box and then replying YES. Text messages are covered by the GlamOps Messaging Terms at https://glamops.net/legal/messaging-terms, which include how to stop texts (reply STOP) and get help (reply HELP).
9.4 Replies. Replies to messages go to the Business. GlamOps may process them to provide the service (for example, to handle STOP or HELP), but does not monitor or respond to them.
10. Privacy
10.1 The Business's privacy notice. The Business decides how your information is used for its services. Its privacy notice and consumer health data privacy policy are linked in the Booking Site footer.
10.2 GlamOps's role. GlamOps processes your information on the Business's behalf as its service provider, under the GlamOps Data Processing Addendum (https://glamops.net/legal/dpa). GlamOps does not sell your information, does not use it for advertising, does not use it to train AI models, and does not use it to market to you. The GlamOps Privacy Policy is at https://glamops.net/legal/privacy, and the GlamOps Consumer Health Data Privacy Policy is at https://glamops.net/legal/health-data-privacy.
10.3 Privacy requests. To access, correct, or delete your information, contact the Business. If you contact GlamOps, we will pass your request to the Business.
10.4 Cookies. GlamOps Booking Sites use only cookies and similar tools needed to run the site and first-party analytics for the Business. They do not use third-party advertising cookies. GlamOps honors Global Privacy Control signals. See the Cookie & Tracking Notice at https://glamops.net/legal/cookies.
11. Acceptable conduct
When using a GlamOps Booking Site or Client Portal, you agree not to:
- (a) make fake, abusive, or bad-faith bookings, or book using someone else's identity or payment card without permission;
- (b) upload or send anything unlawful, threatening, harassing, hateful, or sexually explicit, or anything that infringes someone else's rights;
- (c) try to access another person's account or data, or any part of the site you are not authorized to use;
- (d) interfere with the site, including by using bots, scrapers, or automated booking tools, or by trying to get around security or rate limits;
- (e) upload viruses or malicious code; or
- (f) use the site for any illegal purpose.
GlamOps or the Business may cancel bookings or block access for anyone who breaks these rules.
12. Disclaimers
12.1 As is. GlamOps provides the Booking Site, Client Portal, and related tools "as is" and "as available." To the fullest extent the law allows, GlamOps disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2 No guarantees about the Business. GlamOps does not guarantee, endorse, or make any promise about any Business, its services, its licenses, or its policies.
12.3 Availability. GlamOps does not promise the site will always be available, error-free, or secure, or that messages (including reminders) will always be delivered on time. Do not rely only on a reminder to remember your appointment.
12.4 Your rights. Some states do not allow certain warranty disclaimers. In those states, some of this Section may not apply to you.
13. Limit on GlamOps's liability
13.1 No liability for the Business's services. GlamOps is not liable for any injury, reaction, loss, or damage that results from services provided by a Business, or from a Business's acts, omissions, policies, forms, or charges.
13.2 Types of damages. To the fullest extent the law allows, GlamOps is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities, arising out of or related to these terms or your use of a GlamOps Booking Site or Client Portal.
13.3 Cap. To the fullest extent the law allows, GlamOps's total liability to you for all claims arising out of or related to these terms or your use of a GlamOps Booking Site or Client Portal is limited to the greater of: (a) the fees GlamOps itself received in connection with your bookings in the 12 months before the claim (not counting amounts paid to the Business); or (b) US $100.
13.4 What is not limited. Nothing in these terms limits liability that cannot be limited by law, such as liability for gross negligence, intentional misconduct, or rights you have under consumer protection laws that cannot be waived.
14. Disputes with the Business
14.1 Contact the Business first. Questions or disputes about services, prices, deposits, fees, refunds, cancellations, or results are between you and the Business. Please contact the Business directly. Its contact details are on the Booking Site and your confirmation.
14.2 Card disputes. You may have rights to dispute a charge with your card issuer. The Business, not GlamOps, responds to those disputes. GlamOps may provide the Business with the records described in Sections 5.4, 6, and 7.5 to help it respond.
14.3 GlamOps's help. If you cannot reach the Business, you may contact GlamOps at admin@glamops.net. GlamOps may try to put you in touch with the Business but cannot decide the dispute or issue refunds for the Business.
14.4 Release. To the extent the law allows, you release GlamOps from claims arising from disputes between you and a Business.
15. Disputes with GlamOps
15.1 Talk to us first. If you have a problem with GlamOps, email admin@glamops.net and describe it. We will try to resolve it informally within 30 days.
15.2 Governing law. These terms are governed by the laws of the State of Oregon and applicable US federal law, without regard to conflict-of-law rules. This does not take away any protection you have under the consumer laws of the state where you live.
15.3 Where to bring a claim. Either of us may bring a claim in small claims court in your county of residence or in Multnomah County, Oregon, if it qualifies. Otherwise, claims must be brought in the state or federal courts located in Multnomah County, Oregon, unless the law of your state gives you the right to sue where you live.
16. Changes to these terms
GlamOps may update these terms. The version that applies to a booking is the version you accepted when you made it. If we make material changes, we will show the new version, and you will be asked to accept it the next time you book or sign in to the Client Portal. The "Last updated" date at the top shows when these terms last changed.
17. Other terms
17.1 Entire agreement. These terms, the Messaging Terms (if you opt in to texts), and the policies referred to in them are the entire agreement between you and GlamOps about the Booking Site and Client Portal. Your agreement with the Business is separate.
17.2 Severability. If any part of these terms is found unenforceable, the rest stays in effect.
17.3 No waiver. If GlamOps does not enforce a part of these terms, that is not a waiver.
17.4 Assignment. You may not transfer these terms. GlamOps may transfer them as part of a merger, acquisition, or sale of assets.
17.5 Accessibility. If you have trouble using a Booking Site because of a disability, see our Accessibility Statement at https://glamops.net/legal/accessibility, or contact the Business to book another way.
17.6 Contact. GlamOps LLC, admin@glamops.net.
